NAAC Calls for Transparent and Apolitical Process in Albtelecom
Investigation
 
Washington, DC, February 18, 2004: The National Albanian American
Council (NAAC) issued the following statement regarding its call for
transparent and apolitical process in Albtelecom investigation. 
 
The recently circulated report regarding the AMC/Vodafone and local
rural fixed line operations relationships with Albtelecom should set off
blaring alarms.  The report has been sponsored by the International
Telecommunication Union (ITU), an international organization within the
United Nations <http://www.unsystem.org/>  System with 186 member
countries, including Albania.   The report analyzes Albania’s
telecommunications sector and arrives in conclusions that clearly bring
the skewed nature of these relationships to the surface. 
 
The three page circulated excerpt points out that the agreements between
these entities are in conflict with Albania’s Telecommunications Act.
They also contain an acutely discriminatory fee structure to the
disadvantage of Albtelecom, and therefore ultimately to the Albanian
people.  Finally, the parties are contracted for four years where in the
rapidly changing telecommunications world the industry standard is one
year with rights to renegotiate and adjust thereafter.
 
The details underlying the agreements so disadvantage Albtelecom that
the report concludes; “it must be said that there is not a single
example in Europe or wider with such unfair interconnection deals for
the fixed operator.”  It further states that the agreements threaten the
“complete collapse of Albtelecom.”
 
The report goes on to make recommendations with which we agree.  The
government must bring in qualified domestic and international experts to
assist the regulatory authority in restructuring the Albtelecom deals
and thus immediately bring to an end the losses to the Albanian people
that are the result of these grossly unfair arrangements.  They must
also bring in a team led by a world renowned auditing firm to assess the
present value damages of the erroneous elements of the agreements.  They
should then bring legal action to recover lost funds that have resulted
from these patently unfair arrangements.  In addition, as it was
recently approved by the parliament, an immediate investigation but with
the presence of international experts should be launched to determine
whether these deals were the result of incompetence, gross negligence or
corruption; the results of such investigation should be made public and
filed with the Prosecution Office.  Finally, measures must be undertaken
to ensure that proper procedures and mechanisms are developed to prevent
such discriminatory and harmful arrangements in the future. The fact
that the Albanian government until recently had not taken any action in
line with the ITU recommendations and had not made public its existence
despite having apparently received the ITU report since early December,
further highlights the emergency of our proposals.  
 
However, the process should be fully transparent and must not be
politicized.  Any lack in transparency will bring about more questions
than answers and politics will only dilute and overshadow this process.
Our proposed international component throughout this process will help
ensure the much needed objectivity.  The National Albanian American
Council is ready to offer its assistance in identifying and supplying
experts in the fields of telecommunications, law, accounting or any
other field of expertise that may be required to help bring a just and
speedy resolution to this issue. Only swift, professional, and
transparent corrective measures will restore what rightfully belongs to
the Albanian people and will serve to strengthen Albania’s struggling
democracy.

DEKLARATË PËR SHTYP

 
KKSHA-ja bën thirrje për një proçes transparent dhe jo-politik në
hetimin e Albtelekom-it
 
 
Washington, DC, 18  shkurt 2003: Këshilli Kombëtar Shqiptaro Amerikan
(KKSHA) lëshoi këtë deklaratë për shtyp në lidhje me zhvillimin e një
proçesi transparent dhe jo-politik në hetimin e Albtelekomit. 
 
Një raport i shpërndarë kohët e fundit mbi AMC/Vodafone në lidhje me
marrëveshjen e linjave tokësore fikse të Albtelekomit duhet të alarmoj
gjithë opinionin publik. Raporti është sponsorizuar nga Bashkimi
Ndërkombëtar i Telekomunikacioneve (International Telecommunication
Union – ITU), një organizatë ndërkombëtare në gjirin e sistemit të
Kombeve të Bashkuara me 186 vende anëtare duke përfshirë edhe
Shqipërinë. Ky raport analizon sektorin e telekomunikacioneve në
Shqipëri dhe mbërrin në konkluzione që vënë në dukje natyrën e padrejtë
të këtyre marrëdhënieve.
 
Tre faqet e shpërndara nga ky raport tregojnë që marrëveshjet e krijuara
nëpërmjet këtyre dy firmave janë në konflikt me Aktin Shqiptar mbi
Telekomunikacionet. Raporti gjithashtu vë në dukje një strukturë taksash
që janë diskriminuese ndaj Albtelekomit dhe rrjedhimisht ndaj popullit
shqiptar. Ne kete marreveshje, palët kanë lidhur një kontratë 4-vjeçare,
ndërkohë që në botën e telekomunikacioneve, standarti është një kontratë
nje  vjeçare me të drejtën për të rinegociuar më pas.
 
Detajet e kësaj kontrakte e vënë Alblekomin në një disavantazh të tillë
sa raporti përfundon me këto fjalë: “duhet thënë që nuk ekziston asnjë
shembull tjetër i vetëm në Evropë ose më gjerë me të tilla marrëveshje
të padrejta për ndërlidhjet. Raporti përmend gjithashtu se kjo
marrëveshje rrezikon të krijojë një “shpërbërje to plotë të
Albtelekomit”.
 
Ne jemi dakord me rekomandimet që bëhen në raport. Qeveria duhet të
caktojë eskpertë shqiptarë dhe të huaj që të asistojnë autoritetet
perkatese në ristrukturimin e  marrëveshjeve të Albtelekomit, në mënyrë
që t’i jepet fund humbjeve që po pëson populli shqiptar si pasojë e
kontratave tejet të pandershme. Ata duhet të sjellin një grup të
udhëhequr nga një firmë e njohur inspektimi financiar për të vënë në
dukje dëmet e bëra nga gabimet në këtë kontratë. Ata duhet tu drejtohen
organeve ligjore për të marrë fondet e humbura si  rezultat i
padrejtësive të kësaj marrëveshjeje.  Gjithashtu, ashtu siç u aprovua
nga parlamenti, duhet të fillohet një hetim i menjëhershëm me
pjesmarrjen e ekspertëve të huaj. Ky hetim duhet të zbulojë nëse këto
marrëveshje janë rezultat i pazotësisë, i neglizhencës së hapur apo i
korrupsionit. Rezultati i këtij hetimi duhet të bëhet publik dhe të
dorëzohet në zyrën e prokurorisë. Së fundi, duhen marë masa për tu
siguruar që në të ardhmen do të zhvillohen proçedurat dhe mekanizmat e
duhur për të shmangur marrëveshje të tilla të padrejta. Megjithëse
qeveria shqiptare e kishte marë raportin e ITU-s që në fillim të
dhjetorit, ajo jo vetëm që nuk kishte implementuar asnjë nga masat e
rekomanduara por edhe nuk e kishte bërë publik këtë raport. Ky fakt
tregon më së miri urgjencën e propozimit tonë. 
 
Ky proçes duhet të jetë transparent dhe nuk duhet politizuar. Mungesa e
transparencës do të sjellë më shumë pyetje se përgjigje dhe politizimi
do të sjellë hije mbi këtë proçes. 
Pjesemarrja e specialisteve te huaj, te cilen ne po propozojme, do te
ndihmoje ne sigurimin e objektivitetit te nevojshem. Këshilli Kombëtar
Shqiptaro Amerikan është i gatshem të ofrojë ndihmën e tij për të
identifikuar dhe sjellë ekspertë në fushën e telekomunikacioneve, në
fushën ligjore dhe ekonomike, ose në fusha të tjera për të arritur në
një konluzion të shpejtë e të drejtë të kësaj çështjeje. Vetëm masa
korrigjuese, të shpejta, profesionale dhe transparente do t’i rikthejnë
popullit shqiptar atë çka i përket dhe do të forcojnë demokracinë
shqiptare.
 
 
Këshilli Kombëtar Shqiptaro Amerikan (KKSHA) është një organizatë
jo-përfituese dhe jo qeveritare e dedikuar ndaj advokimit të çështjeve
shqiptare, promovimit të paqes dhe zhvillimit ekonomik në Ballkan për të
forcuar politikat demokratike, për të inkurajuar respektin për të
drejtat e njeriut, dhe duke mbajtur programe zhvillimi dhe edukative.
