FOR INCITEMENT TO RACIAL HATRED AND DISCRIMINATION Greek Helsinki Monitor (GHM) announces that on 13/1/2003, Public Prosecutor Helene Skeparnia indicted the management of the Greek newspapers ?Ta Nea? and ?Ependytis? and the magazine supplements ?Akinita stin Ellada? (in the Thursday issues of ?Ta Nea?) and ?Symbol?, for inciting racial hatred and discrimination through published material. The indictment was made following complaint reports filed by GHM on 8/1/2003, for violation of articles 1 (prohibiting racial discrimination or hatred) and 2 (prohibiting public expressions through the press of ideas offensive to persons due to their origin) of Law 927/1979 (as amended with Law 1419/1984). This law was amended with article 39, paragraph 4 of Law 2910/2001, which enables the prosecutor to issue indictments ex officio. As Greece has admitted in its relevant reports to international organizations, the antiracism law was almost never applied and, as far as is known, the only ex officio indictments ever been issued were the ones following complaints by GHM, in August 2002 (http://www.greekhelsinki.gr/bhr/english/organizations/ghm/ghm_13_08_02.rtf) and January 2003. Hopefully, the Greek justice system will properly apply the antiracism law in the trials which are expected to be set for the near future given the brief statute of limitation for these offences. It is underlined, however, that the indictments of last August have not led to trial dates so far: the Chief of the Prosecutor?s Office of Athens was already alerted by GHM that there is a danger for the offences to be statute-barred because of the delay. Hopefully, the ?Public Prosecutor?s Year 2003? announced by the Public Prosecutor of the Supreme Court a few days ago will not be blackened by negligence in an area whose developments are monitored by the UN and Council of Europe institutional instruments combatting racism. These institutions have already criticized Greece for the lack of punishment (also) for offences of racial hatred and discrimination. GHM pressed charges against ?Ependytis? and ?Symbol? for publishing the following article by Marina Sakale-?Lady Marks?, on 12/10/2002: ?Even a holy man needs to be threatened. And the Albanian even more, or so does the lady believe. Because, she concludes, an Albanian can turn his benefactors into real-life martyrs. ? The Ottoman army was afraid of one single thing: Albanians. And I don?t mean just as opponents but also as comrades-in-arms. Albanians were regarded as the best of warriors. They had no equal in massacring and looting, they always fought in their own battalions, and they had their own officers. Turks regarded them as being indispensable because they were brave, fearless and sabre-rattling. Still, it was impossible to impose military discipline upon them and make them loyal to the Sultan. Turks and Kurds would fight for the Sultan and Islam, but Albanians would fight for something more concrete: the loot. The battalions of Turk-Albanians (Muslim Albanians) were the fear of Greek rayas (subordinates), because their excessive enthusiasm in the repression of liberation rebellions was proverbial. The Albanians could not demonstrate any spirit of co-operation, not even towards their other comrades; at nights, after the looting, fights would break out between them and there were stabbings over the loot. We should not forget that the Greek word ?besha? is of Albanian origin and means ?word of honor?. The Ottoman army would always ask Albanians to give ?besha?, their word of honor, before hiring them, because the latter ones had many times stabbed their comrades ?babeshika?, i.e. with no honor, at the back. ? I recall all these because every time I come to Greece, I hear an avalanche of complaints from my mother?s side and numerous friends on that ?terrible? situation that exists in our country because of the ?Albanian plague?. I have friends who were so generous to Albanians, offering them work and accommodation; they baptized them, thus becoming their spiritual parents. Some Albanians do have ?besha? when they come to Greece. But plenty of them are ?babeshides?, [i.e. with no ?besha?, no good word of honor]. For example, a friend of mine recently discovered by accident, that the Albanian she had baptized had been baptized twice more. She was furious and when she mentioned this to him, the Albanian confessed that he did it for the golden crosses and the gifts he would get. ?We are poor people. What else can we do? We have to make a living somehow?, he told her with a shy smile. But when my friend decided to drive him away, he threatened to kill her and her family. Another couple, friends of mine, had employed an Albanian as their driver. They bought suits for him, neckties and shoes. When he was injured seriously in a motorcycle accident, they visited him in hospital and even paid for his hospitalization. They even thought of becoming his god-parents. When they decided to repair their house in Glyfada, they asked him to stay there for the duration of the works. He was an unfortunate Albanian they had taken under their wings and they had tried to help him stand on his own two feet. Things were fine until the work finished and it was time for him to leave the house. ?But I live here?, he told them, ?you can?t kick me out of my home?, and he closed the door in their faces. The couple called the police, and, naturally, they removed him from the house. They decided not to ask for his prosecution, and to cast their bread upon water. (Those Greek waters are filled with the Greek bread given to Albanians). However, they reckoned without their Albanian host. He filed a complaint against his friend, claiming that he had used coarse language calling him a ?dirty Albanian?. My friend, who happens to be a university professor with academic distinctions on antiracism, was acquitted triumphantly. However, half the university had to take the stand and save him from the claws of the Albanian and the Albanian-lover pettifogging lawyer who was advising him to press charges against his benefactors. By the way, the Albanian had entered Greece illegally using a fake passport and he had already one conviction against him. I have an endless pool of stories like that. ? What did the Turks in the Ottoman army do to discipline those indispensable Albanians and make them have some ?besha?? They would make an example of them, punishing them in the harshest of ways. When I say ?make an example out of them?, I mean an example for the others, because the recipients of the punishment would not survive to learn their lesson. And it seems that even Turks have something useful to teach us in this area. Because when the Greek Navy decided to sink some boats with Albanians those who plague the poor citizens of Corfu the problem went away in Corfu. However, there is also the other side to the Albanian coin. Karaiskakis, Miaoulis, Kanaris, Bouboulina, Tzavelas, Kolokotronis? the list is endless. They were all heroes of the Greek Revolution [of 1821], and they were all of Albanian origin. The difference was that they had accepted Orthodox Christianity and Greek culture, and their descendents, and the descendents of half of the Greek population of Albanian origin, are Greeks. And they are some of the best ones. ? This will also be the case with Albanians in two generations time. As long as, in the short term, we exhibit exemplary cruelty to those who break the law, in order to respect us and the type of society we have managed to create, and in the long term, to integrate them in our nation through our religion and culture.? In the past, GHM had pressed charges against ?Ta Nea? and the real estate supplement, ?Akinita stin Ellada?, for routinely publishing want-ads that contain the specification ?no foreigners.? The following persons testified yesterday and today as complainants or witnesses before the competent magistrates: Gregory Vallianatos, GHM Chairperson; Nafsika Papanikolatou, Minority Rights Group-Greece Spokesperson; Halouk Pirali, President of the Foreign Refugee Association of Greece; Panayote Dimitras, GHM Spokesperson; Angeliki Kotsantoni, GHM Migrants Project Coordinator; Reimonda Celniku, sister of Albanian citizen Gentjan Celniku who was killed by a police officer. Haluk Pirali and Reimonda Celniku also constituted themselves civil claimants, considering themselves as being directly offended by the racist ads and the Albanophobic article respectively. In their testimonies, all the above stressed the accountability of democratic newspapers that chose among the multitude of letters, ads and articles they receive, many of which they don?t publish, to publish texts with this sort of racist content, without any disclaimer, and thereby create the impression that such opinions are acceptable in democratic discourse. In this way, they are contributing to the development of a climate of racial hatred and discrimination. As one witness stated, ?If I wanted to read articles like that I would have bought extreme-rightwing, racist newspapers?! Reimonda Celniku added that a similar climate of ?Albanophobia? contributed to the murder of her brother. Similar accountability is assigned to the publication of racist want-ads., which call for the systematic marginalization of refugees and immigrants. The complaints cite all relevant articles in the international instruments of the UN and the Council of Europe prohibiting and calling for the punishment of all forms of racial discrimination, which Greek judges now, and perhaps for the first time, are called upon to take into consideration. We are grateful for your readiness to discuss several human rights related problems in Greece with GHM. We also appreciate the recent appropriate measures within the powers of your Ministry, which you have taken to avoid miscarriages of justice, which might lead to impunity for human rights abuses. We also welcome the positive stand that the new Greek Ombudsman, Professor George Kaminis, has taken towards an effective implementation of all legislation, which would guarantee the human rights of all individuals living in Greece. Despite these positive attitudes among high-ranking authorities, there appears to be a serious failure of some members of the Greek judicial system to deal with incitement to hatred and discrimination punishable under Greek legislation, in particular under Law N? 927/1979 as amended by Law N? 1419/1984 and Law No 2910/2001. In the past twelve months, seven cases against the publication of anti-Semitic, xenophobic or racist texts in the press have been filed by Greek Helsinki Monitor on the basis of the above-mentioned legislation. Regrettably, however, one of these cases has lapsed due to inactivity on the part of the prosecutors; one has ended up in acquittal despite overwhelming evidence that Greek law had been violated; and four are in the process of being quashed, again, despite overwhelming evidence of breaches of law: in two of them, a trial date of 26 September 2003 had first been set and then cancelled. A detailed memo on GHM?s anti-racist litigation is attached (see http://www.greekhelsinki.gr/bhr/english/organizations/ghm/anti-racist_litigation\ .doc). ? Two of the filed cases concern an openly anti-Semitic letter published in Eleftherotypia on 15 April 2002 and in Ta Nea on 16 April 2002. We are shocked to learn that the indictment chamber recently quashed the first case after a date for the trial had already been set, and that the charges against Ta Nea are under consideration to be dropped. The defamatory letter read, among other things: ??It?s a proven fact that Jews are untrustworthy and fickle. They infiltrate societies, first playing the poor souls to generate pity and, when the time comes, they?ll grab you by the throat.? ? A court in Patras dismissed a case against the Patras neighbourhood associations, which in November 2001 had published a blatantly racist letter against Roma in local newspapers in June 2003. The letter read: "Roma steal from the [non-Roma] resident's fields, they snatch what they can find from the yards of the homes. They loot our cemetery, they swear, they beat people, they ring our bells. They should be immediately evicted from the area; any postponement or delay in resolving the problem we face will lead to militant action from the residents." ? In a further case a Greek prosecutor moved so slowly that no trial could be held against the publisher of a xenophobic letter because the statute of limitation had expired and the case lapsed. The case concerned a letter that was published on 26 January 2002 in the financial supplement Economicos Tachydromos of the daily To Vima. The letter read, for example: ?Migrants, the scum who are being channelled into Greece. They have come just on a whim, to kill, rob and rape Greece.? ? In the case of two complaints filed against Ta Nea in which the paper continued, despite warnings, to publish want ads for homes for rent and sometimes for jobs that ended with the phrase ?no foreigners,? ?foreigners excluded.? One of the cases was quashed before a date for the trial was set, in the other the date for trial was set but the case went back to the prosecutor who recommended that the charges be dropped. After a year of litigation, only one case -- a case against ?Albanophobia? -- is still proceeding in the judicial system. The case was filed because of a letter published on 12 October 2002 in the financial weekly Ependytis (in its supplement Symbol) and read, among other things: "The 'terrible' situation exists in Greece because of the 'Albanian plague.' We should exhibit exemplary cruelty to those who break the law, in order for Albanians to respect us and the type of society we have managed to create." The outcome of the above-mentioned cases appears to be a clear indication of the lack of will among some prosecutors and judges to hold trials or convict persons for statements that are openly racist, xenophobic or anti-Semitic -- and which are penalized by Greek law and international standards. In light of the above information, the IHF and the GHM respectfully urge you to take all possible measures within your legal competence to ensure that: ? All prosecutors and judges are provided with the necessary training and instructions to rigorously implement Greece's anti-racist legislation which is part of Greece?s human rights obligations; ? The four cases against Eleftherotypia and Ta Nea be reviewed by the Supreme Court and then referred to trial before most lapse in October 2003; ? The case against neighbourhood associations be reviewed by the Supreme Court and then referred to an Appeals Trial; ? An investigation be launched into the slow judicial procedure in the To Vima case that led it to lapse before any ruling or trial and sanctions be imposed against those held responsible; ? The pace of judicial proceedings concerning the press, which have an eighteen-month statute of limitation period, will be accelerated in order to ascertain that no litigations will lapse solely on the ground that the statute of limitation has expired as a result of inactivity by prosecutors or other judicial personnel; ? The new EU Race Equality Directive be transposed into national law, worded in a way that would effectively exclude that such cases may not be tried, and taking into consideration the related recommendations of the Greek National Commission for Human Rights; ? Greece makes the declaration under Article 14 of the International Convention for the Elimination of All Forms of Racial Discrimination (ICERD) it had pledged to the Committee on the Elimination of Racial Discrimination (CERD) in March 2001, so that individual or group complaints could be lodged to CERD (Greece and the UK are the only EU members who have not made such declaration to date); ? Keto pretendime kane arritur kulmin e tyre gjate zgjedhjeve lokale te zhvilluara 4 vjet me pare ne Himare dhe Dhermi, por po ashtu ato kane gjetur vend edhe gjate gjithe takimeve qe delegacioni i Parlamentit Europian ka zhvilluar me ata te Kuvendit te Shqiperise. Bollano dhe te tjere, u ankuan atehere per parregullsi te theksuara gjate ketyre zgjedhjeve. Por fale guximit dhe paanshmerise se eurodeputetes gjermane Doris Pack qe kryesonte kete mbledhje, pretendimet e pales greke u hodhen poshte. Po ashtu, opinioni shqiptar eshte njohur me odisene e leterkembimit te sterzgjatur ndermjet komisionerit te ngarkuar per marredheniet me jashte Kris Patten dhe eurodeputetit te djathte grek Kristos Ksarhakos. Dosja e ketij leterkembimi eshte aq e fryre sa do te mjaftonte per nje liber te tere. Ne nje nga letrat e dy europarlamentareve greke, perkatesisht Stavros Xarchakos dhe Kristos Zacharias, te grupimit te partive popullore dhe demokrate europiane, shkruhej se kryebashkiaku socialist i komunes se Himares ka aprovuar 15 urdheresa per shkaterrimin e ndertesave dhe pronave qe i takojne pakices greke ne Himare. Sipas parlamentareve greke keto shkaterrime kane prapavije te paster politike. Dy eurodeputetet i kerkuan komisionerit Patten tu thoshte se cfare qendrimi mban Komisioni Europian ndaj akteve te tilla dhe nese veprime te tilla raciste te autoriteteve shqiptare kunder grekeve etnike ne Shqiperi a jane ne perputhje me parimet e pranuara nga shtetet anetare te BEse? Dhe se fundi, cfare masash te menjehershme do te merren per te ndaluar persekutimin e pakices greke ne Himare nga ana e Shqiperise? Ne pergjigjen e tij, zyrtari i larte i Bashkimit Europian theksonte se ne Bruksel nuk jane ne dijeni te shkaterrimit te pronave qe i takojne minoritetit grek atje. Ne rastin konkret ne Himare nuk jane prishur vetem lokalet dhe pronat e banoreve me origjine greke, por edhe atyre shqiptare,  deklaroi Patten. Por rasti i eurodedeputetit Ksarhakos dhe te tjereve eshte vetem maja e ajsbergut, pjesa e dukshme e perpjekjeve te politikaneve greke ne pretendimet e tye ndaj Shqiperise se Jugut. Parlamenti Europian ka qene deshmitar i perpjekjeve shume me konsekuente dhe te hapura te personaliteteve greke ndaj Shqiperise se Jugut. Ne vazhden e perpjekjeve te tyre te pakursyera per te mbeshtetur pretendimet e PBDNJse, eurodeputetet greke organizuan pak muaj me pare edhe nje konference shtypi ne Parlamentin Europian me pjesemarrjen edhe te eurodeputeteve greke dhe atij minoritar shqiptar, Karamelo etj. Te gjithe ata folen per shkelje te te drejtave te minoritetit grek ne Shqiperi, per Himaren e cila prej 4000 vjetesh eshte greke, etj. Per me shume, ata shperndane edhe nje lloj broshure te shkruar ne greqisht ku shpaloseshin te gjitha kendveshtrimet dhe pretendimet e pales greke ndaj Shqiperise se jugut. Para kesaj ofensive klasa politike shqiptare ka qene gjithmone e percare. Ose edhe me keq akoma. Per hir te ruajtjes ose te marrjes se pushtetit udheheqesit dhe politikanet shqiptare u kane bere jehone metimeve te pales greke. Keshtu, p.sh deklarata nje vit me pare e udheheqesit te opozites shqiptare, se ne Shqiperi dhunohen te drejtat e pakicave ndersa ka ushtuar nga njera ane si nje rrufe ne qiell te kthjellet, nga ana tjeter ajo ishte ne sinkron te plote me propaganden greke. Shume komente dhe kritika pati po ashtu pas takimit qe Nikolas Gejxh zhvilloi muaj me pare me 2 udheheqesit e politikes shqiptare. Opinioni shqiptar u befasua ne menyre te vecante nga takimi qe perfaqesuesi i lobit grek ne SHBA zhvilloi me udheheqesin e opozites shqiptare Sali Berisha. Aq me shume qe ne kohen e ?sundimit? te tij, Berisha e pat shpallur Gexhin si ?persona non grata?, pra te padeshiruar. E verteta eshte se takimi BerishaGejxh paraqet edhe ai nje vijimesi konstante ne politiken e 5 viteve te fundit edhe te kreut te opozites shqiptare. Pra asgje nuk eshte e rastit apo e pallogaritur deri ne imtesi. Gjate gjithe ketyre debateve binte ne sy qendrimi i heshtur, i ftohe deri edhe indiferent i perfaqesuesve te Partise Demokratike, kur anetare te pakices greke ne Shqiperi ose europaralamentare greke akuzonin shtetin shqiptar per shkelje te te drejtave te minoritetit, per manipulime gjate votimeve ne Himare dhe Dhermi etj. etj. Partia Demokratike, ishte e vetmja atehere qe mbeshteti ankesat e pales greke, duke pranuar se ne Dhermi dhe Himare ka pasur manipulime. Ndoftadikush mund te thote se te gjitha keto qendrime, deklarata etj, do te kthehen ne leter boshe, porsa Berisha te marre pushtetin. Ai atehere do u veje kufirin te thana pretendimeve greke, sic beri gjate periudhes 19921996. Kjo mund te jete e vertete, por edhe e kunderta mund te jete po aq e vertete. Koha ka treguar qe ne perpjekjet per te marre apo mbajtur pushtetin behen shpesh here pazarlleqe qe kane pasoja edhe me vone. Historia e Shqiperise njeh personazhe qe ne kembim te ndihmes se te huajve, kane pranuar nje Shqiperi gjysmake, jo vetem pa Kosoven, por qe edhe te fillonte ne lumin Mat dhe te perfundonte ne Shkumbin, duke ia lene pjeset e tjera Serbise, Malit te Zi, Bullgarise apo Greqise. Por edhe sikur keto krahasime historike apo supozime te mos kene asnje baze, ka disa argumente bashkekohore, qe ngjallin frike per te ardhmen e Shqiperise se Jugut. Eshte fakt i njohur qe ne kancelarite e Bashkimit Europian po shqyrtohet nder te tjera, si nje opcion i mundshem i zgjidhjes se statusit perfundimtar te Kosoves, edhe ndarja e saj. Sipas ketyre projekteve Serbise mund t?i jepet pjesa e Mitrovices dhe ndofta edhe disa zona te tjera. Njekohesisht pjesa serbe e Bosnjes do t?i bashkangjitet po asaj. Kuptohet qe Beogradi eshte njeri nga frymezuesit, perkrahesit dhe perfituesit me te madhenj te ketij skenari, megjithese tani per tani ai ben naze dhe hiqet sikur do gjithe Kosoven. Ne fakt Beogradi e do Kosoven ose nje pjese te saj, por pa shqiptaret. Sipas ketyre projekteve te pashpallura zyrtarisht, nje Kosove e tille e gjymtuar mund te lejohet te bashkohet edhe me Shqiperine. Ne kete variant te nderrimit te kufijve mund te perfshihet tani apo edhe pas 10 vjetesh edhe Maqedonia dhe Shqiperia. Atehere pushteti lokal ne Himare, apo edhe ne Dropull e tjeterkund ne Shqiperine e Jugut mund te organizoje referendume mbarepopullore per shkeputje nga Shqiperia dhe bashkengjitje me Greqine. Askush nuk ka te drejte t?i kundervihet ketyre aspiratave. Ne kete menyre edhe harta e Shqiperise ndryshon perseri. Epiqendra e saj spostohet drejt veriut duke u shkeputur nga ato treva qe kane nxjerre nga gjiri i tyre nje plejade te shkelqyer rilindasish dhe njerezish te penes qe i kane bere nder gjithe kombit shqiptar. For more than half a century the Macedonian Diaspora cast out of Greece during the country's bloody civil war have been barred from returning to their homeland. Now the army of elderly refugees has been granted a temporary homecoming, if not the return of the money and property seized during the savage conflict that pitted them against their fellow countrymen. Greece is finally facing up to its history of 'ethnic cleansing' and beginning the process of extending full rights to its minorities, who faced decades of persecution and discrimination under successive oppressive regimes and right-wing dictatorships. The move comes as the pro-European government of Prime Minister Costas Simitis pushes Greece gingerly toward a more diverse, tolerant, and some might say European and democratic society. Nevertheless, it will be a hard task to shake off the pervasive belief in the ethnic 'purity' of 'true Greeks'. Even the return of the Macedonian community is temporary. The concession, announced by the Greek deputy foreign minister Andreas Loverdos in July, only allows them to enter Greece between August 10 and October 30 and limits their stay to a maximum of 20 days. For many the homecoming itself is a slap in the face. Macedonian political activists were refused at the border and there were rumours of a blacklist. Those whose passports contained the old Macedonian-language names of their villages were turned away and told to get new passports listing the new Greek names. Only 300 of the 100,000 Macedonians banished from Greece have returned. One hundred and fifty were turned away and many more cancelled their travel plans when they heard about the border problems. For those Macedonians who have managed to cross the border in recent weeks, there have been emotional reunions with family members, and visits to villages and former homes. For others, however, there has been only heartache. Former residents of the ethnic Macedonian village formerly known as D'mbeni discovered the Greek army had not only changed the name, but bulldozed all the buildings, including the graveyard, where their relatives and ancestors were buried. During the Nazi occupation of Greece, more than 10,000 Macedonians, who were Greek citizens, became resistance fighters in the communist-controlled National Popular Liberation Army (ELAS). Following liberation, they found themselves embroiled in a civil war against the pro-royalist Greek Democratic National Army (EDES). In 1949 ELAS finally surrendered, bringing the war, which had lasted nearly five years, to an end. 'Laws still prevent Pomaks living outside their traditional villages' Greece's collective memory of the civil war remains keen; strong enough that this army of elderly immigrants is still considered a threat to the security of the Greek Republic. The returning Macedonians have also made Greece aware of another uncomfortable reality: not all Greeks speak Greek and are Greek Orthodox Christian. Panayote Dimitras, spokesman for the Greek branch of Helsinki Monitor, a human rights group, said: "Greek society has been educated to believe that if you are not Greek-speaking and a Greek Orthodox Christian then you are not a good Greek or a real Greek. They have nothing to fear from these people. They might have come and said strong words against Greece. So what? We are a strong democracy. It was about time for these people to return." Pavlos Voskopulos, of the Rainbow political party of ethnic Macedonians in Greece, adds: "Anyone expressing a different ethnic, national or linguistic identity is often stigmatised in the public and in the media. They are accused of being anti-Greek." According to the US State Department's 2002 Human Rights report on Greece: "Laws restrictive of freedom of speech remained in force, and some legal restrictions and administrative obstacles on freedom of religion persisted..." According to researchers, minorities in Greece number between 5% and 10% of the population, or between 500,000 and one million people. These include not only ethnic Macedonians, but Gypsies, Turks, Romanian-speaking Vlachs, indigenous Albanians, and Pomaks: Muslims with Koranic names and traditions, who speak an archaic dialect of Bulgarian. Officially, however, only a 'Muslim minority' is recognised, created by the 1923 Treaty of Lausanne which ended war with Turkey. Because it makes no distinction between Turkish, Gypsy and Pomak Muslims, the Greek state has been able to manipulate the Muslims' identities according to country's political interest. The restrictions on Pomaks' movement, for example, continued until 1995. The Simitis government finally struck down Article 19 of the constitution in 1998, which allowed the state to revoke the citizenship of "non-ethnic Greeks" who travelled abroad without permission. But there are still laws on the books which prevent Pomaks from living outside their traditional villages, although they are not enforced. Voskopulos, of the Rainbow party, said: "We are talking about a united Europe, a European identity. Everyone knows how important it is to respect diversity. Today to discriminate against people at such a broad level is completely unacceptable." SCARS OF CIVIL WAR THE Greek Civil War, which broke out in 1946, was fought between British and American-backed government forces and communist guerrillas. The two main forces that had resisted the Nazi occupation - the communist-controlled National Liberation Front-National Popular Liberation Army (EAM-ELAS) and the Greek Democratic National Army (EDES) - came into conflict after EAM-ELAS set up a provisional government that rejected the Greek king Constantine (right) and his government-in-exile. Ethnic Slav-speaking Macedonians, related to kin in socialist Yugoslavia to the north, fought for autonomy and aligned with the leftist insurgents. To deny the communists local support, more than 700,000 villagers were forcibly evacuated from mountains and dumped into miserable camps near towns. In total, around 3,000 government executions were recorded during the conflict. By the time the civil war ended in 1949, with the surrender of the communist guerrillas, some 100,000 people were dead and one million displaced. Ethnic Macedonians were singled out for reprisals because of their support for the leftists. About 60,000 Macedonians fled, including 28,000 children, across the border to Yugoslavia, the Republic of Macedonia and the new People's Republic of Bulgaria. Police officers were actively involved in what happened in Belgrade's Republic Square on 30 August and, with a group of extremists from Kosovo, settled scores with a "Serb traitor," namely me, and then issued a press release on how the "mercenary" insulted the displaced and slapped one of them on the face. True, I did slap a "patriot" from Kosovo because I was forced to defend myself from the torrent of "Serb patriotism," insults, blows, and pushing. I was alone in the midst of "patriots," which in Serbia means people who are allowed by the authorities to physically and with weapons assault their political opponents. I slapped a man older than myself after his third assault on me. What were my options: to try to defend myself or let him kick me in the name of "Serb patriotism"? These are the facts about the 30 August event in Belgrade at the assembly of the Association of Families of Missing Kosovo Serbs. I find it extremely concerning that Serbia has a police force that assassinated the country's Prime Minister in the name of Serbdom, and that it makes no secret of wanting to continue settling scores with "Serb traitors." Two plainclothes officer at the assembly, who looked like hooligans, not members of an institution whose primary duty is to protect human dignity, pulled me this way and that and shouted at me. The taller one used his hands and some kind of shoulder bag he was carrying, and the shorter one his huge stomach. "They (the Association) see you as a traitor and being in foreign pay, so you had better leave," the policemen told me. They seemed delighted that someone, in this case Kosovo Serbs, had at last decided to give a "Serb traitor" a thrashing, and repeated the words countless times while supposedly protecting me. Shortly before that, they both watched calmly as old men, women, and men in top physical form hit me and pushed me around. Nor did they react when a big man with a mustache and yellow shirt pushed me hard in the back and nearly knocked me to the ground. The expression on the faces of the two policemen was easy to read: All those like her should be killed. If it's so easy for that man to lift his hand at me, what did he do in Kosovo during the NATO bombing, was the thought that crossed my mind. Where were you, Mr Minister, and your colleagues in the Serbian government on 30 August, the World Day of Missing Persons? It was a fine opportunity for you to see the "patriotic forces" in your ranks and the mood of the Kosovo Serbs. Had you been there, you would have seen men like Zvezdan Jovanovi?, relentless against "traitors" and ready for violence. But of course, it was not a place for ministers and their bodyguards. You must take good care of yourselves for, as you keep telling us, your lives are in danger. Do any of you realize that, with your bodyguards, jeeps, factories, and rhetoric, you increasingly resemble those same patriotic forces you accuse of assassinating the Prime Minister? I do not rule out the possibility of some elements of the police and others in Serbia again organizing themselves to protect Serbdom and take action against "traitors." Have you or others in the government been informed that the assassination of Prime Minister Djindji? was occasion for celebrations in some police stations and departments? Thousands of drug dealers were arrested during Operation Saber, as if the Prime Minister died of an overdose and not a sniper's bullets. And how many of those in the ranks of the "patriotic forces" were arrested and are still in custody? Let me tell you - only a couple of dozen and these "deserving Serbs" were treated with the greatest respect. Police inspectors, their comrades in arms during the war, saw to their comfort in jail. The talk in Vojvodina is that one Slobodan "Boca" Medi?, the wartime commander of the "Scorpion" reserve police unit, spent three weeks in custody in Novi Sad and was very pleased with how he was treated: visits from family, homecooked meals and profuse apologies for being held. The only reasons I can see for the high regard in which this wartime commander is held is his order to his bodyguards to shoot a group of Srebrenica Muslims and burn their bodies to destroy the evidence, and the liquidation by his unit of "Albanian terrorists" - women and children - in Podujevo during the NATO bombing. At the end of the war, this man was a hero and very rich, and is still "Commander Boca" to Serb fighters. He owns a huge house in Novi Sad, a big farm in the country, automobiles, jeeps, and motor cycles, and has good connections with the police and an enormous amount of money thanks to being the number one in the oil business in Djeletovci, Slavonia, up to the Erdut Agreement. We are grateful for your readiness to discuss several human rights related problems in Greece with GHM. We also appreciate the recent appropriate measures within the powers of your Ministry, which you have taken to avoid miscarriages of justice, which might lead to impunity for human rights abuses. We also welcome the positive stand that the new Greek Ombudsman, Professor George Kaminis, has taken towards an effective implementation of all legislation, which would guarantee the human rights of all individuals living in Greece. Despite these positive attitudes among high-ranking authorities, there appears to be a serious failure of some members of the Greek judicial system to deal with incitement to hatred and discrimination punishable under Greek legislation, in particular under Law N? 927/1979 as amended by Law N? 1419/1984 and Law No 2910/2001. In the past twelve months, seven cases against the publication of anti-Semitic, xenophobic or racist texts in the press have been filed by Greek Helsinki Monitor on the basis of the above-mentioned legislation. Regrettably, however, one of these cases has lapsed due to inactivity on the part of the prosecutors; one has ended up in acquittal despite overwhelming evidence that Greek law had been violated; and four are in the process of being quashed, again, despite overwhelming evidence of breaches of law: in two of them, a trial date of 26 September 2003 had first been set and then cancelled. A detailed memo on GHM's anti-racist litigation is attached (see http://www.greekhelsinki.gr/bhr/english/organizations/ghm/anti-racist_litigation.doc). ? Two of the filed cases concern an openly anti-Semitic letter published in Eleftherotypia on 15 April 2002 and in Ta Nea on 16 April 2002. We are shocked to learn that the indictment chamber recently quashed the first case after a date for the trial had already been set, and that the charges against Ta Nea are under consideration to be dropped. The defamatory letter read, among other things: " It's a proven fact that Jews are untrustworthy and fickle. They infiltrate societies, first playing the poor souls to generate pity and, when the time comes, they'll grab you by the throat." ? A court in Patras dismissed a case against the Patras neighbourhood associations, which in November 2001 had published a blatantly racist letter against Roma in local newspapers in June 2003. The letter read: "Roma steal from the [non-Roma] resident's fields, they snatch what they can find from the yards of the homes. They loot our cemetery, they swear, they beat people, they ring our bells. They should be immediately evicted from the area; any postponement or delay in resolving the problem we face will lead to militant action from the residents." ? In a further case a Greek prosecutor moved so slowly that no trial could be held against the publisher of a xenophobic letter because the statute of limitation had expired and the case lapsed. The case concerned a letter that was published on 26 January 2002 in the financial supplement Economicos Tachydromos of the daily To Vima. The letter read, for example: "Migrants, the scum who are being channelled into Greece. They have come just on a whim, to kill, rob and rape Greece." ? In the case of two complaints filed against Ta Nea in which the paper continued, despite warnings, to publish want ads for homes for rent and sometimes for jobs that ended with the phrase "no foreigners," "foreigners excluded." One of the cases was quashed before a date for the trial was set, in the other the date for trial was set but the case went back to the prosecutor who recommended that the charges be dropped. After a year of litigation, only one case -- a case against "Albanophobia" -- is still proceeding in the judicial system. The case was filed because of a letter published on 12 October 2002 in the financial weekly Ependytis (in its supplement Symbol) and read, among other things: "The 'terrible' situation exists in Greece because of the 'Albanian plague.' We should exhibit exemplary cruelty to those who break the law, in order for Albanians to respect us and the type of society we have managed to create." The outcome of the above-mentioned cases appears to be a clear indication of the lack of will among some prosecutors and judges to hold trials or convict persons for statements that are openly racist, xenophobic or anti-Semitic -- and which are penalized by Greek law and international standards. In light of the above information, the IHF and the GHM respectfully urge you to take all possible measures within your legal competence to ensure that: ? All prosecutors and judges are provided with the necessary training and instructions to rigorously implement Greece's anti-racist legislation which is part of Greece's human rights obligations; ? The four cases against Eleftherotypia and Ta Nea be reviewed by the Supreme Court and then referred to trial before most lapse in October 2003; ? The case against neighbourhood associations be reviewed by the Supreme Court and then referred to an Appeals Trial; ? An investigation be launched into the slow judicial procedure in the To Vima case that led it to lapse before any ruling or trial and sanctions be imposed against those held responsible; ? The pace of judicial proceedings concerning the press, which have an eighteen-month statute of limitation period, will be accelerated in order to ascertain that no litigations will lapse solely on the ground that the statute of limitation has expired as a result of inactivity by prosecutors or other judicial personnel; ? The new EU Race Equality Directive be transposed into national law, worded in a way that would effectively exclude that such cases may not be tried, and taking into consideration the related recommendations of the Greek National Commission for Human Rights; ? Greece makes the declaration under Article 14 of the International Convention for the Elimination of All Forms of Racial Discrimination (ICERD) it had pledged to the Committee on the Elimination of Racial Discrimination (CERD) in March 2001, so that individual or group complaints could be lodged to CERD (Greece and the UK are the only EU members who have not made such declaration to date); ? Nje burim prane deges socialiste te Himares, deklaroi per "KJ" mbremjen e se shtunes se nepermjet shume telefonatave nga emigrante shqiptare te vendosur ne Athine, kane mesuar faktin qe kandidati per kryetar Bashkie Vasil Bollano po ben fushate te hapur elektorale ne kryeqytetin grek. Me grupe emigrantesh ne ambjente publike, kandidati i PBDNJ-se Bollano "i mbeshtetur edhe nga PD-ja), ju ka kerkuar emigranteve qe te vijne ne Himare dhe voten tia japin atij per te larguar qeverisjen e majte. Bollano ka paraqitur edhe alternativat e tij se cfare do te bejne per Himaren dhe nese do ta marre ne dore Omonia, Himara do te jete ndryshe. Fushata sipas tyre ka nisur te premten dhe do te vazhdoje edhe ne ditet e para te javes qe vjen. Sipas burimeve, kjo lloj fushate eshte kundershtuar nga grupe te tjera emigrantesh, madje edhe perfaqesues te konfederates se emigranteve qe e kane konsideruar shkelje te ligjit berjen e fushates per zgjedhjet vendore ne ambjentet publike te Athines. Per nje gje te tille, eshte vene ne dijeni edhe Komisioni Qendror i Zgjedhjeve. Socialistet himariote besojne se Bollano mbeshtetet dhe financohet nga ekstremiste greke, perfshi ketu edhe deputete qe "enderrojne vorio-epirin", te cilet angazhohen me te gjithe menyrat ne cdo fushate elektorale. Zemerimi i himarioteve ka te beje me perfshirjen ne kete fushate edhe te shoqates "Himara" qe sipas tyre drejtohet nga nje anti-himariot Engjell Kolavashi. Reagon kandidati socialist Goro I gjendur ne nje klime te tille te krijuar ne qytetin e Himares, kandidati socialist per kryetar bashkie Jorgo Goro ne nje konference per shtyp ka deklaruar se kjo fushate eshte "e jashteligjshme" e megjithate, "kjo nuk e tremb pasi voten do ta hedhin himariotet". "Dhe nese vijne 500 emigrantet per te votuar, numer qe eshte present ne cdo fushate zgjedhore, vetem 20 perqind e tyre mbeshtesin kandidatin e PBDNJ-se Bollano.
