*** 'Perfect Storm' filmmakers sued BOSTON (AP) - The family of doomed fishing boat captain Frank William "Billy" Tyne Jr. is suing the makers of this summer's big screen hit "The Perfect Storm," contending he was depicted in a "false and unflattering light." Tyne's two daughters and his wife filed a lawsuit Thursday in U.S. District Court in Orlando, Fla., against Time Warner Entertainment and the two companies that produced the film. The lawsuit contends that Tyne was cast in a negative light in the film, that it was produced without their consent and their privacy was violated. "The family felt wronged, and they wanted something done," said the family's attorney, Stephen Calvacca of Orlando. "Fiction, as fiction, is protected speech. Fiction, masquerading as fact, is not protected." Time Warner released a statement Tuesday saying that the studio did not need permission from Tyne's family to make the film or portray him. The studio challenged the claim that Tyne was depicted in a negative light. "We most certainly disagree with the plaintiffs' claim that the film in any way disparaged Mr. Tyne or tarnished his memory. This lawsuit implicates fundamental First Amendment freedoms and we intend therefore to vigorously defend it," the statement said.
