General UN Principles

UN Charter and Related Covenants

Within the UN Charter three provisions are important when analyzing the
legal foundations of self-determinations.

Chap. 1, Art. 1, Para. 2 firmly embeds the principle of self-determination
in the mission of the UN. The relevant language instructs the UN:

"To develop friendly relations among nations based on respect for the
principle of equal rights and self-determination of peoples".

Chap 1, Art. 2, Para. 4, however, reduces the breadth of this statement by
stating that UN member states:

"shall refrain in their international relations from the threat or use of
force against the territorial integrity or political independence of any

Chap. 11, Art. 73, The Declaration Regarding Non-self-governing Territories,
provides useful insight in the UN providing the right of self-determination
to people under colonial rule.

Besides the UN Charter the International Covenant on Economic, Social and
Cultural Rights http://www.unhchr.ch/html/menu3/b/a_cescr.htm  and the
International Covenant on Civil and Political Rights

peoplešs right to self-determination in Part 1, Art. 1 and obligates states
to promote the realization of peoplešs right to self-determination in Part
1, Art. 3.

The General Assembly


Declaration Granting Independence to Colonial Countries and Peoples (1960)
relies primarily on the principle of self-determination to forcefully
criticize colonialism.
